In most, if not all States rivers, creeks and/or streams that are tributaries draining into larger waterways are considered public property. The ground on either side of the river/creek/stream banks is often private property. In all States, these waterways are legally designated as 'Waters of the U.S.' and are not privately owned by the landowners who own the property on either side. Fishermen are not trespassing when they are within the confines of the stream banks. In this video both the landowner and the fisherman are standing within the banks on public property.

actually you cannot own waterways, and even the banks are not ownable, same as the beaches, you could own a property that extends right to the water, but you cant tell people theyre not allowed to be on your beach. all you can do is put a fence up and make it difficult for people, but even then if they wanna walk through the water and access your land, theyre allowed to do so.

Based on his behavior and his seething need for IDs, he probably has close ties to the Blue Line Gang, if not a member. Which means if he was able to coerce your IDs, he and his buddies would continue to harass you for months or even years if you are locals. The Blue Line Gang are easily offended by anyone that doesn't kiss their boots, they especially love targeting young people that are often unaware of the protections the law offers against Blue Line Gang harassment tactics.

The ignorance of many of the comments is ridiculous. Read the law FFS. Yes, if the river is deemed navigable then you have a right to navigate a boat through private land that the river crosses. BUT, you must access the river from another public location. You are trespassing if you set foot on the private land by docking your boat or by crossing the land to access the river. If the waterway is not deemed navigable then you have absolutely no rights to it and are trespassing by being in or near it on private property. End of story.

Sometimes there are marked roads (seen on google maps or earth) that are old logging roads. Often they are on National Forests or State Parks. But sometimes they are on privately land. I use to hunt areas in the mountains of West Virginia where the land owner had 500 acres I was hunting on. But the upper part of the mountain, past his land was part of the Monongahela National Forest. The old logging roads at the top of the mountain had a gate just like the ones you showed. At that point it was a forest service road. We could walk on it and hunt there, but we had to park outside the gate. If we walked on that forest service road/trail far enough we would be on the private property we had permission to hunt on (we came into his place from the bottom). One step National Forest. The next step private property. And there were not markers on those old logging roads. Of course there were national forest markers around the perimeter that are maybe 6" and every 100-200 yards. I'm not suggesting you were on private. But sometimes you can be and not know it. On the subject of a public river: It use to be rivers were considered navigable. Just like a public road. But there are some of the trout streams in WV that you will be charged with trespassing if your feet are on the land under the water; let alone on the bank within the high water mark of the stream. It all has to do with how the judicial system works in that county and how the outsiders have abused privileges and trashed the rivers. With the modern infrastructure of roads that we have now, the judicial system will not see a need to use a stream to navigate/travel. I use to jump in streams any place a bridge crossed and wade up or down fishing as I went. But that gets dicey now. Good luck. Have Fun!

If you do not own the property or POSITIVE that it is State Land then you have NO business to be ON IT PERIOD. Further, yes, you are allowed to be IN any river or waterway... but as soon as you stand on land or a rock where you are OUT of water then you are TRESPASSING ... plain and simple... easy fix - STAY OFF property that is NOT yours or State Land
